In reference to a Notice of Proposed Rulemaking (NPRM) by the U.S. Department of Labor’s Wage and Hour Division, on August 30, 2023, we published this piece:  

THE U.S. DOL PROPOSES SIGNIFICANT INCREASES TO THE FLSA MINIMUM SALARY FOR EXEMPT EMPLOYEES

 

The proposed rulemaking to revise 29 CFR Part 541’s interpretation of the Fair Labor Standards Act’s exemptions from the minimum wage and overtime pay requirements for executive, administrative, and professional employees was published in the Federal Register on September 8th, 2023.  

  

For these classes of exempt workers, the minimum standard salary would typically increase to $1,059 per week.   

 

The total annual salary level for highly compensated employees would increase to $143,988 under the proposed modifications.   

 

The DOL recommended that these income standards be automatically updated every three years.     

 

The DOL invites employers and other interested parties to submit written comments concerning the proposed rule starting today through November 7, 2023, a 90-day timeframe.
